Effects of Cancellation:
In the event cancellation of contract is mutually agreed upon purchaser and seller must return all goods and other services rendered. Where applicable, any benefits from utilisation of goods, or any wear, tear or partial consumption entitle seller to compensation. This does not apply to removal of packing or the like in the course of normal inspection of goods on receipt, as would occur in a normal shop. Said compensation is best avoided if purchaser does not utilise goods in any way or manner but returns these goods without delay if at all feasible.
Purchaser must bear return charges if goods are delivered as ordered and purchase price does not exceed € 40, or, if price is higher and, at the time of cancellation, purchaser has failed to meet his contractual obligations or make contractually agreed down-payment. Otherwise, return charges are borne by seller.
If returning of goods is not feasible collection will be arranged.
Any payments to be returned are due within 30 days from date of cancellation.
Cancellation can not be accepted with goods as named in § 312 d Para 4 BGB. They include but are not limited to
- Supplies of goods made to customers specification or particular personal requirements, goods which can not be marketed elsewhere, furthermore goods which are perishable or have otherwise exceeded their useful life,
- Supplies of proprietary video, audio or software electronic storage media whose seal has been broken.
